One document set reveals that even after TSA employees identified cancer clusters possibly linked to radiation exposure, the agency failed to issue employees dosimeters – safety devices that could assess the level of radiation exposure. Another document indicates that the DHS mischaracterized the findings of the National Institute of Standards and Technology, stating that NIST “affirmed the safety” of full body scanners. The documents obtained by EPIC reveal that NIST disputed that characterization and stated that the Institute did not, in fact, test the devices.

Obamacare prescription: ‘Emergency health army’

President Obama’s recently passed health-care reform legislation includes a surprise for many Americans – a beefing up of a U.S. Public Health Service reserve force and expectations that it respond on short notice to “routine public health and emergency response missions,” even involuntarily.

According to Section 5210 of HR 3590, titled “Establishing a Ready Reserve Corps,” the force must be ready for “involuntary calls to active duty during national emergencies and public health crises.”

Apparently, this exemption will apply similarly to believers in Islam, which considers health insurance – and, for that matter, any form of risk insurance – to be haraam (forbidden).

President Barack Obama signed the Senate health care bill into law yesterday that will exempt the President, his cabinet secretaries and special congressional staff members from participation in the new government-run health care “exchanges.”

Rank-and-file House and Senate staffers will be forced out of the Federal Employees Health Benefit Plan (FEHBP) and into the restricted federal health insurance exchanges, but not the leadership or committee congressional staff or the federal civil service bureaucrats who will be making your health care decisions for you.

Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.

To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved.

In the first sentence, Congress will amend the McCarran-Ferguson Act to allow interstate competition in health insurance.

We can’t have a free market in health insurance until Congress eliminates the antitrust exemption protecting health insurance companies from competition. If Democrats really wanted to punish insurance companies, which they manifestly do not, they’d make insurers compete.

House Ways & Means Republicans released a shocking new report yesterday exposing the new and expanded role of the IRS in Democrats’ new government takeover of health care. (The full report can be viewed here.)

The IRS is the Democrats’ chosen instrument of enforcement for the new health insurance mandates. Should the bill become law, the IRS will have sweeping new powers and authorities and will grow in size exponentially to accommodate its new role in health care mandate enforcement.

• IRS agents verify if you have “acceptable” health care coverage;
• IRS has the authority to fine you up to $2,250 or 2 percent of your income (whichever is greater) for failure to prove that you have purchased “minimum essential coverage;”
• IRS may need to hire as many as 16,500 additional auditors, agents and other employees to investigate and collect billions in new taxes from Americans;
• IRS can confiscate your tax refund;
• IRS audits are likely to increase;
• IRS will need up to $10 billion to administer the new health care program this decade; and
• Nearly half of all these new individual mandate taxes will be paid by Americans earning less than 300 percent of poverty ($66,150 for a family of four.)

The Republicans noted that despite the new mandates on American citizens, the Democrats prohibit the IRS from imposing these same taxes and penalties on illegal immigrants.
